Terms & Conditions Agreement


The agreement sets out the legally binding terms and conditions for use of the website at instaattire.co.uk and all services provided by Insta Attire Ltd. 

Access to and use of this Web site and the products and search services available through this Web site (collectively, the “Services”) are subject to the following terms, conditions and notices (the “Terms of Service”). By using the Services, you are agreeing to all of these terms, conditions and notices, without modification. Furthermore, you acknowledge that the Terms of Service may be updated by us from time to time. This Web site also contains links to other Web sites, Web pages and services, which are not operated by Instaattire.co.uk (the “Linked Sites”). Your use of such Linked Sites will be subject to the terms of service contained within each such site and the respective terms of service will control the use of the respective site. In any event your link through to such a site will be subject to these Terms of Service. You recognise that Insta Attire has no control over such Linked Sites and information, and you accept that Insta Attire provides no guarantee as to the accuracy or reliability of such sites or the information contained in them and you agree that we shall have no responsibility as to whether such links locate unintended or objectionable content or otherwise cause you distress, loss or damage

Products and Availability

Insta Attire will notify brands of low availability on a weekly basis and it is the Brand Partners duty and responsibility to provide replenishment of stock or new stock to replace low holding items.

Insta Attire will aim to hold a high level of shop floor detail and presentation which can only be achieved by Brand Partner co-operation in keeping at least 50% availability of stock. Empty rails and fixtures could be replaced by other brands in order to maintain shop presentation. Therefore, we ask all Brand Partners to supply products in timely manner and enough stock to fill each fixture.

Brand Partners with low level of communication and inability to fill fixtures in a timely manner could lead to contract termination.

All products must arrive to Insta Attire with wash labels and undamaged. All damaged products will be reported and sent back to the Brand Partner and at the cost.

All products must be barcoded and have a description tag which Insta Attire can also supply but at a cost of an additional £150 per month regardless of Brand Partners product quantity and range.

All products sold via Insta Attire’s website will be packaged using Insta Attire’s own packaging unless otherwise stated by the Brand Partner.

Brand Partners are fully responsible for providing the online listing description and pictures. Brand Partners also warrant that the information and pictures comply with Insta Attire’s policies. You also must warrant that you are legally able to sell each item and accurately describe each item. You must also inform Insta Attire if you wish to remove or recall any products from both the online listing and retail shop floor.

Brand Partners are solely responsible for setting the prices for each item which includes sale or promotion prices, which includes both online and retail.

Brand Partners are free to utilise the Insta Attire’s logo on their website and products but must inform Insta Attire before doing so. Insta Attire could and ay refuse this at any point. Insta Attire can also reject and demand the removal of the Insta Attire logo at any point.

Insta Attire can use Brand Partners logo on the website, in the shop, social media and any other marketing material to promote the Brand Partner’s products without notice. Brand Partners can also opt out by informing Insta Attire formally either by email or a posted letter. 


Upon termination of this concession agreement the Brand Partner will remove all belongings from the premises and return the property to its original state.

Insta Attire reserves the right to terminate this concession agreement without prior approval or warning.

The Brand Partner may request termination with the submission of written notice no sooner than 30 days prior to requested termination date. This includes both online and retail Brand Partners.

Insta Attire may at any time terminate or suspend any part of the service without notice to you.


If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law. 

 Refunds and Exchanges

All refunds will be handled through the refund policy which is outlined and defined below.

The refund policy will be printed on the back of all receipts at the time of purchase:

Intsa Attire will exchange or refund any unworn products which is returned in its original condition with 30 days of purchase along with customer receipt. Refunds will be completed using the original method of payment. In case of debit/credit card purchases, this will be completed only to the same card the item was purchased on. The following items are not eligible for returns or exchange:

Underwear, swimwear, earrings, tights, fragrances without seals, accessories without the original packaging.

Any item sold via our website through an external link to Insta Attire’s partner’s website will operate on a different refund policy. Please see their individual refund policy terms and conditions.

All refunds will be charged back to Brand Partner’s accounts and payment added to the monthly account.

Customers are only able to exchange products for other items in the same brand. Customers cannot exchange form one brad to another brand. 

Online Refund Policy

Thanks for purchasing our products at insterattire.co.uk operated by Insta Attire.

In order to be eligible for a refund, you have to return the product within 30 calendar days of your purchase. The product must be in the same condition that you receive it and undamaged in any way. You must notify Insta Attire by email if you wish to return any items and provide all item codes and order number which is on your receipt. Customers can use the original packaging by reversing the bag then use the returns label.

Customers are also advised to retain the proof of postage in case of missing parcels.

After we receive your item, our team of professionals will inspect it and process your refund. The money will be refunded to the original payment method you’ve used during the purchase. For credit card payments it may take 5 to 10 business days for a refund to show up on your credit card statement.

If the product is damaged in any way, or you have initiated the return after 30 calendar days have passed, you will not be eligible for a refund.

The following items are not eligible for returns or exchange:

Underwear, swimwear, earrings, tights, fragrances without seals, accessories without the original packaging.

Insta Attire will look to obtain £100 deposit fee from all potential retail Brand Partners. This deposit is a security method to reserve a particular space(s) on the retail store floor. The deposit will be deducted from final balance on the customer’s invoice. Brand Partners can pay the deposit either via telephone or through the website. The deposit can be refunded post a 6 month period of paying the deposit if the retail site has not launched by that time.

Brand Partners are charged 5% (retail and online Partners) and 20% (online only Partners) commission for all sales which include reduced and promotional items.

Brand Partners who rent retail space will be required to pay for full 12 months’ rent prior to stocking their products and will not be charged for online advertisement apart from 5% commission rate for online sales.

Online only Brand Partners will be charged £10 per month and will be required to pay full 12 months subscription up front. Online only Brand Partners will also be charged 20% commission on all sales which includes discounted and promotional stock.

Failure to supply any of the above fees could lead to immediate termination of the Agreement and removal of products from both website and retail space.

All services and products offered by Insta Attire are stated in UK GB Pounds Sterling.

Stock Loss

Insta Attire will aim to have zero stock loss with the use of CCTV, security tagging of all items and weekly inventory checks. However, Insta Attire cannot guarantee zero product loss and damage. Any items lost or damaged will be at the cost of the Brand Partner and not Insta Attire.

Insta Attire will aim to provide full details of any missing items or damaged products to the Brand Partner on a weekly basis via the inventory update sheet.

Privacy Policy

Insta Attire will not forward, sell or disclose on any of your personal or business information to any third party without your explicit consent. We expect the Brand Partner to also abide by this Privacy statement and not sell or disclose any of Insta Attire’s private information. Under Insta Attire’s privacy policy we may disclose to third parties certain information contained in our Users’ registration applications, but we will not disclose your name, address, email address or telephone number unless we have informed you, been authorised by you, or are required to do so by law, subject to the Data Protection Act 1998. Membership Admissibility

All brand partners agree to provide 100% accurate information on the Initial Interest Application form and all other completed documents. You also confirm by signing this agreement that you are at least 18 years of age.

You also agree to all local laws which includes online conduct. You as the Brand Partner are fully in charge and responsible for you own local tax laws and paying them when due.

Insta Attire may also change, update and amend any terms and conditions at any point and your use of this service could also be subject to those changes, which have been incorporated into this Agreement.

 No Warranty

Insta Attire’s website and its Directors and all stakeholders provide no warranty or conditions and is ‘as is’. 

Liability Limit

Insta Attire and its Directors, employees, contractors or other suppliers in NO event shall be liable for any damages whatsoever whether direct, indirect, general, special, consequential, compensatory or incidental raising out of your conduct or anyone else in connection of this Agreement.


You the Brand Partner, agree to indemnify and hold Insta Attire Limited and its Directors, staff, contractors and agents harmless free from any claim or demand, including reasonable legal fees made by any third party due to your breach of this agreement, or your breach of any law or rights of a third party or documents incorporates by reference.


If any provisions of this Agreement is held unenforceable, then such provision will be amended to reflect the parties intention. All remaining provisions of this Agreement shall remain in full force and effect.

No Guarantee

Insta Attires website and retail store may be effected by many external and internal reasons. Therefore Insta Attire cannot guarantee uninterrupted and continues access to both the online and retail site.

Insta Attire must also comply with all regulations set and held by both the Landlord and shopping mall provider. This includes access and operating dates and times.

Insta Attire Service

Insta Attire reserves the right to modify the Insta Attire website and its services at any point without notice and at any time. Insta Attire also reserve the right to modify these Terms of Use or any other pages within the website at any time. We therefore would like to encourage all users to regularly check the website. Any fundamental changes made to the website and its content will be stated via email notification. Please ensure all your contact details are up to date and inform info@instaattire.com if there are any changes.

Choice of Law

This agreement shall be in all respects be interpreted and governed by the laws of England and Wales. Insta Attire must also comply with all regulations set and held by both the Landlord and shopping mall provider. This includes access and operating dates and times.

Resolution of Disputes and Release

In the event of any dispute between Insta Attire and its Brand Partners with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.


No membership and all sections within this contract shall survive at expiration or termination of this Agreement.


Insta Attire will and shall provide notices by email or by post unless otherwise stated by any party. Insta Attire will view a notice has been given 48 hours after the email has been sent or two working days after a postal delivery has been sent.

If you wish to make any complaints or provide any form of feedback, please do so by emailing info@instaattire.com . We will aim to answer and deal with all complaints as soon as possible.  


You will not: commit or encourage a criminal offence; send or receive any material which is in any way offensive or obscene, or in breach of confidence, copyright, privacy or any other rights; act contrary to the acceptable use policies of any Linked Sites or community standards generally; transmit or distribute a virus; hack into any aspect of the Service; corrupt data; cause annoyance to other Users; infringe upon the rights of any other person’s trademarks or other proprietary rights; send any unsolicited advertising or other promotional material, commonly referred to as “spam”; or attempt to affect the performance or functionality of any computer facilities of or accessed through the Insta Attire’s Web site.

 Disclaimer of warranties

The services and all information, products and other content included in or accessible from this website and the linked sites, are provided on an “as is” and “as available” basis and are subject to change at any time without notice to you. To the fullest extent permitted by law, Insta Attire disclaims and excludes all representations and warranties (express, implied and statutory, including but without limitation the warranties of merchantability and fitness for a particular purpose, and non-infringement of proprietary rights) as to the services and all information, products and content included in and accessible from this web site or the linked sites.

Disclaimer of liability

Unless expressly stated to the contrary to the fullest extent permitted by law Insta Attire, its content providers, advertisers or linked sites shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this website or the linked sites, even if Insta Attire had been advised of the possibility of such damages and irrespective of whether such damages arise in contract, tort, equity, restitution, by statute, at common law or otherwise. You have read this disclaimer and agree to it on the basis that you agree it is reasonable. 

 Intellectual Property 

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content appearing on this Website shall remain at all times vested in Us or Our licensors. Insta Attire is a registered trademark owned by Us.

Events Outside Our Control  

We will not be liable or responsible for any failure to perform, or delay in performance of, any of Our obligations under this Contract that is caused by events outside Our reasonable control (“Force Majeure Event”).

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond Our reasonable control and includes, in particular (without limitation) the following:-

  1. a) strikes, lock-outs or other industrial action;
  2. b) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
  3. c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
  4. d) Impossibility of the Use of railways, shipping, aircraft, motor transport or other means of public or private transport;
  5. e) Impossibility of the Use of public or private telecommunications networks;
  6. f) The acts, decrees, legislation, regulations or restrictions of any government.

Our performance under the Contract is deemed to be suspended for the period that the Force Majeure Event continues, and We will have an extension of time for performance during that period. We will Use Our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which Our obligations under the Contract may be performed despite the Force Majeure Event
